This is a pure sign of Congressional ineptitude. I'm actually not supporting the estate tax, but that's not my argument here. The country didn't repeal the tax, just for one year they had a lapse on it. And because Congress failed to bother to fix this, there is a massive inconsistency in the tax system. If they are going to have the tax, they might as well keep it consistent. I guess that would have been too much to ask.
